Privacy Policy

This Privacy Policy describes how NiftyBot LLC (“NiftyBot,” “we,” “us,” or “our”) collects, uses, discloses and otherwise processes personal information in connection with the June mobile application, the june.fm website, and any related products, features and services (collectively, the “Services”). NiftyBot is the controller of personal information processed under this Privacy Policy. By using the Services, you acknowledge that you have read and understood this Privacy Policy. Capitalized terms not defined here have the meanings given in our Terms of Service.

1. Information We Collect

Information you provide to us.

• Account information, such as your name, email address (including an Apple private relay address) and account identifiers received when you sign in with Apple or another sign-in method we offer.
• Profile and preference information, such as your time zone, language, stated listening interests, the shows you follow (“Regulars”), the collections you create (“Flows”) and your settings.
• Content you submit, such as messages, requests and instructions you type or speak to June, including text transcribed from your voice, and any feedback, survey responses or support requests.
• Transaction information, such as the products you purchase, prices, dates and payment status. Payment card details are collected and processed by our payment processors, including Apple, and are not stored by us.

Information collected automatically.

• Listening and usage information, such as episodes you play, skip, finish, replay, download or remove; playback position; interactions with features, screens and content; and the dates, times and duration of your activity.
• Device and connection information, such as IP address, approximate location derived from IP address (for example, country or region), device type, operating system, app version, language settings, and device, advertising and other identifiers.
• Log, diagnostic and performance information, such as crash reports, error logs and service performance data.
• Cookies and similar technologies. We and our partners may use cookies, pixels, software development kits (SDKs), local storage and similar technologies on the Services, as described in Section 6.

Information from third parties. We may receive information about you from Apple and other sign-in providers, payment processors, analytics and advertising partners, and other business partners, and we obtain publicly available information such as podcast feeds and related metadata.

2. How We Use Information

We use personal information for the following purposes:

• To provide, operate, maintain and support the Services, including creating and managing your account, building Flows, recommending and playing content, generating spoken briefings, and responding to your requests in June Chat.
• To personalize the Services, including learning your listening preferences and tailoring content, recommendations and features to you.
• To develop, train, test and improve the Services, our artificial intelligence features, and new products and features.
• To conduct analytics and research, including measuring usage, engagement and performance.
• To display advertising and sponsored content, including advertising personalized based on your activity, and to measure its effectiveness.
• To process transactions, subscriptions and payments.
• To communicate with you, including sending service, security and account notices, and, subject to applicable law, marketing and promotional communications.
• To protect the safety, security and integrity of the Services, our users and others, including preventing fraud, abuse and unauthorized access, and enforcing rate limits.
• To comply with legal obligations, enforce our Terms of Service and other agreements, and establish, exercise or defend legal claims.
• For any other purpose disclosed to you at the time we collect the information or with your consent.

We may create aggregated, de-identified or anonymized information from personal information and use and disclose it for any lawful purpose.

3. Artificial Intelligence Features

The Services use artificial intelligence models, including models provided by third parties. When you use June Chat, receive a briefing or use other AI features, we send your inputs and relevant information about your account and listening activity (for example, your Regulars, Flows and recent episodes) to these providers to generate responses, text and synthesized speech. We may retain, review and use inputs and outputs, including through quality monitoring tools, to operate, secure and improve the Services. AI-generated output may be inaccurate or incomplete.

4. How We Disclose Information

We may disclose personal information to the following categories of recipients:

• Service providers that process information on our behalf, including providers of hosting, database and authentication services, background processing, artificial intelligence and speech services, AI quality monitoring, network, content delivery and security services, analytics, crash reporting, customer support, email delivery and payment processing.
• Platform providers, such as Apple, in connection with sign-in, CarPlay, app distribution and in-app purchases.
• Advertising and analytics partners, which may collect or receive information about your use of the Services and other apps and websites to deliver, personalize and measure advertising and to provide analytics.
• Podcast publishers and hosting providers. Episodes are streamed and downloaded directly from publishers’ servers or their hosting providers, which receive your IP address, device information and request data when you play or download an episode.
• Business transferees, in connection with an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, sale of assets or other corporate transaction.
• Legal and safety recipients, such as law enforcement, government authorities, courts and other parties, where we believe disclosure is required by law or necessary to protect the rights, property or safety of NiftyBot, our users or others.
• Affiliates, and other parties with your consent or at your direction.

5. Retention

We retain personal information for as long as necessary to provide the Services and for the purposes described in this Privacy Policy, including to comply with legal, tax and accounting obligations, resolve disputes and enforce our agreements. When you delete your account, we delete or de-identify the personal information associated with it in our production systems, except where retention is required or permitted by law. Information held in backups, logs and systems of our service providers is deleted in accordance with their retention schedules.

6. Cookies, Tracking and Advertising

We and our partners may use cookies, SDKs and similar technologies to operate the Services, remember your preferences, understand usage, and deliver and measure advertising, including across other apps and websites. Where required, including under Apple’s App Tracking Transparency framework, we request your permission before tracking you across apps and websites owned by other companies. You can manage tracking and advertising identifiers through your device settings. Our Services do not respond to “Do Not Track” signals.

7. Security

We use administrative, technical and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee the security of your information.

8. Your Choices

• Account deletion. You may delete your account in the app under Account → Delete account, or by contacting us.
• Account information. You may review and update certain information in the app.
• Marketing communications. You may opt out of marketing emails by following the unsubscribe instructions in the email. We may still send service and account communications.
• Device permissions. You may disable microphone, speech recognition, tracking and other permissions in your device settings. Some features may not function without them.

9. U.S. State Privacy Rights

Depending on your state of residence, including California, Colorado, Connecticut, Virginia and other states with comprehensive privacy laws, you may have the right to: (a) confirm whether we process your personal information and access it; (b) correct inaccuracies; (c) delete personal information; (d) obtain a portable copy; (e) opt out of the sale of personal information, the sharing of personal information for cross-context behavioral advertising, targeted advertising, and profiling in furtherance of decisions producing legal or similarly significant effects; and (f) limit the use of sensitive personal information, where applicable.

In the preceding 12 months, we have collected the categories of personal information described in Section 1, including identifiers, commercial information, internet and electronic network activity information, approximate geolocation, audio-derived information, and inferences drawn from the foregoing, from the sources described in Section 1, for the purposes described in Sections 2 and 3, and have disclosed them to the categories of recipients described in Section 4. We may “sell” or “share” identifiers, internet activity information and inferences with advertising and analytics partners, as those terms are defined under applicable law. We do not knowingly sell or share the personal information of consumers under 16.

You may use an authorized agent, and we may require proof of the agent’s authority. If we deny your request, you may appeal by replying to our decision. We will not discriminate against you for exercising your rights.

10. European Economic Area, United Kingdom and Switzerland

If you are located in the EEA, the United Kingdom or Switzerland, we process personal information on the following legal bases: to perform our contract with you; for our legitimate interests in operating, securing, improving and promoting the Services, where not overridden by your interests or rights; with your consent, which you may withdraw at any time; and to comply with legal obligations. You may have the right to access, correct, delete, restrict or object to the processing of your personal information, to data portability, and to lodge a complaint with your local supervisory authority.

11. International Transfers

NiftyBot is based in the United States, and we and our service providers process information in the United States and other countries whose laws may differ from those of your country. Where required, we rely on appropriate safeguards, such as Standard Contractual Clauses, for transfers of personal information.

12. Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will delete it. If you believe a child under 13 has provided us personal information, contact us at june.fm/contact.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Last updated” date above indicates when it was last revised. Your continued use of the Services after an update takes effect constitutes acceptance of the updated Privacy Policy, to the extent permitted by law.
